Wild mushrooms can be deadly. Many toxic species closely resemble edible ones, and morphological features vary drastically depending on maturity, habitat, and weather. This App DOES NOT identify mushrooms, does not test for toxicity, and must never be used to decide whether any fungus is safe to touch, harvest, prepare, or consume. All environmental layers, habitat scores, fruiting reference-value overlays, species names, and forecasts are macro-level statistical and educational models only—not botanical identification, not food-safety guidance, and not an endorsement to forage. If you collect, touch, cook, ingest, or distribute wild mushrooms, you assume 100% of the risk. Any resulting illness, poisoning, organ failure, permanent disability, medical expenses, or death is solely your personal responsibility; the Operator, developers, and platform disclaim all legal and financial liability to the fullest extent permitted by law.
Outdoor activity is inherently dangerous. Terrain, weather, wildlife, cliffs, water crossings, getting lost, and hypothermia (among other hazards) can cause serious injury or death. Map data, trails, and routes may be wrong, outdated, or unsafe. You alone decide whether to go outdoors and how to stay safe.
Shared tracks & routes disclaimer: The App allows users to upload, store, and share tracks, photos, and videos. Referencing or following someone else's shared track to forage wild mushrooms involves extreme danger. Shared routes are user-generated, may lead into steep cliffs, flash-flood zones, or toxic mushroom clusters, and are never verified or guaranteed by the Operator. You must independently and rigorously evaluate the safety and feasibility of any shared track before using it. If you get lost, suffer injury, illness, hypothermia, death, or mushroom poisoning from referencing or following another user's track, you assume 100% of the risk and responsibility. The Operator and the original track sharer disclaim all liability.
3D mountain maps & forest areas disclaimer (3D mountain terrain graphics & calculated forest patches disclaimer — timeliness, accuracy & complete waiver of liability): The 3D mountain terrain graphics (topographic meshes, DEM elevations, slope relief, and 3D perspectives) and calculated forest patches / blocks (polygon boundaries, acreage, tree-species compositions, habitat models, mean elevations, historical/forecast weather, fruiting reference-value ratings, and public/protected status) are derived from scientific research and algorithmic data mining of public satellite and geographic datasets. They are theoretical approximations, NOT 100% accurate, and NEVER constitute official cadastral surveys, legal boundary delineations, land title certifications, or engineering-grade topography.
1. Timeliness & Latency: Satellite imagery and elevation surveys carry inherent acquisition latency and cataloging lag. They cannot reflect recent catastrophic geological shifts (flash flood washouts, landslides, mudslides, rockfalls, or road cuts), nor can they capture real-time changes in forestry (timber harvesting, logging operations, wildfires, pest defoliation, seasonal leaf-drop, natural succession, or temporary emergency closures by land authorities).
2. Accuracy & Canopy Concealment Blind Spots: Satellite sensors and elevation models are heavily obscured by dense tree canopies (DSM vs. bare-earth DTM discrepancies). Beneath smooth 3D canopy contours may lie vertical cliffs, sheer drop-offs, hidden sinkholes, treacherous ravines, or loose scree completely hidden from view. Mesh resolutions cannot reproduce backcountry micro-terrain, and 3D perspective foreshortening can distort perceived slope steepness.
3. Complete User Assumption of Risk: Users must always rely on actual on-site conditions. Forest patch indicators never grant legal access or foraging rights. Users bear sole legal responsibility for verifying land tenure and avoiding private property (trespassing) or restricted reserves; the Operator disclaims all liability for citations, fines, or trespassing lawsuits. Never rely on 3D graphics for climbing or off-trail route safety. If an accident, injury, or getting lost occurs from relying on 3D mountain maps or forest data, users assume full personal responsibility; the App and Operator disclaim all liability.
Severe weather & natural disasters (force majeure): Mountain microclimates change rapidly and unpredictably (including sudden flash floods, thunderstorms, hypothermia-inducing drops, and lightning). Weather layers and models are approximate statistical forecasts. You must monitor local official weather warnings and immediately turn back or take shelter when weather degrades. The Operator disclaims liability for accidents or losses caused by severe weather or natural disasters.
Stranger danger, anti-luring & backcountry safety disclaimer (Users assume 100% risk): The App's friends and outing group foraging features are designed solely for communication between acquaintances. The wilderness, backcountry, and deep forest are remote, isolated, and perilous environments with vast cellular dead zones. There are severe risks of bad actors or strangers luring, deceiving, or leading users into remote or hazardous backcountry areas under the pretext of sharing mushroom spots, group scouting, or guiding, resulting in robbery, extortion, fraud, abduction, unlawful detention, physical assault, or life-threatening harm. The Operator does not screen, verify, or endorse the identity, criminal history, or motives of any user. Users must exercise extreme caution, verify identities independently, and never venture into the backcountry alone with unverified strangers. If you interact with, team up with, or meet strangers offline, you assume sole and complete liability for any luring, foul play, personal injury, property loss, or criminal harm; the Operator disclaims all civil, criminal, and joint liability.
Real-time GPS location sharing & live tracking disclaimer (User assumes all risks): Creating an outing, inviting members, or joining an outing explicitly authorizes the App to broadcast your high-precision live GPS coordinates, heading, speed, elevation, and battery level to all group members. Teammates can continuously see your live physical position on the map in real time. This may reveal your daily routines, home area, or private foraging spots, and carries risks of being trailed, stalked, ambushed, or targeted by bad actors. You are solely responsible for deciding whom you share your location with and assume all risks arising from live location sharing. You can use "Pause Sharing" or "Leave Outing" in the App at any time to immediately terminate location broadcast. The Operator disclaims all liability for stalking, harassment, property damage, or injuries resulting from your location sharing.
Independent offline meetups & carpooling (not an event organizer): The App is purely a mapping utility and information tool; it is not a travel agency, tour operator, outdoor club, or event organizer. Any informal carpooling, group hikes, or meetup foraging arranged between users is strictly a voluntary civil undertaking among private individuals. No duty of protection or safety is owed by the Operator or among participants. The Operator disclaims all liability for any traffic collisions, disputes, injuries, or fatalities arising from offline meetups.
Health self-assessment, minor supervision & fire safety: Mountain foraging demands high physical exertion. Individuals with cardiovascular diseases, hypertension, or serious conditions must not engage in high-strain backcountry treks. Minors must be accompanied and supervised by a legal guardian at all times. Users must strictly obey fire bans—never build illegal fires, and practice Leave No Trace.
You assume all risk. Any illness, injury, death, property damage, rescue costs, fines, or other losses arising from use of the App or from outdoor activity are solely your responsibility. To the maximum extent permitted by law, the Mushroom Forecast team disclaims liability for such outcomes.
1.1 These Terms form a binding agreement between you (“you” or “User”) and Beijing Dahuangfeng Information Technology Co., Ltd. (北京大黄蜂信息科技有限公司) (“we,” “us,” or “Operator”), the operator of the Mushroom Forecast mobile application and related U.S.-region services.
1.2 By tapping Agree, creating an account, or otherwise using the App, you confirm that you have read, understood, and accepted these Terms—especially the safety disclaimer above. If you do not agree, do not use the App and uninstall it.
2.1 Mushroom Forecast is an outdoor map and scouting tool. Features may include 3D mountain terrain maps, forest and timber canopy layers, habitat / fruiting reference-value overlays (statistical reference only; not a calibrated chance of fruiting) derived from public environmental data, GPS track recording, cloud storage and sharing of tracks and multimedia (photos/videos), local private pins, offline map packs, and related utilities.
2.2 All models and layers—including 3D mountain terrain graphics, calculated forest patches / blocks (boundaries, acreage, tree compositions, microclimates, and fruiting reference-value overlays), and route suggestions—are approximate inferences derived from scientific data mining and public datasets. They are not 100% accurate, carry inherent time lag, and do not guarantee timeliness, on-site reality, safe passage, or legal land access. Users must always verify conditions and land ownership on site.
3.1 No Mushroom Identification or Safety Certification: The App does not possess or provide any real-world botanical identification, toxicity screening, or edibility certification capabilities. All species entries, descriptions, and fruiting predictions are macro-level ecological inferences and statistical models. They must NEVER be relied upon to identify edible mushrooms or avoid poisonous ones. Never eat wild mushrooms based on information in this App.
3.2 Assumption of Ingestion Risks & Complete Waiver: Wild mushroom consumption entails extreme and unpredictable dangers, including gastrointestinal illness, liver or kidney necrosis, permanent neurological damage, or fatal poisoning. Any decision to touch, harvest, cook, consume, or share wild mushrooms is entirely your voluntary decision. You release and hold harmless the Operator, Beijing Dahuangfeng Information Technology Co., Ltd., its officers, developers, and partners from any and all liability, claims, or damages resulting from wild mushroom exposure or consumption.
3.3 Public lands. Rules for collecting fungi on public land (including National Forests, BLM land, state forests, parks, and other jurisdictions) vary by managing agency, unit, season, and permit status. Personal limits, commercial restrictions, temporary closures, and fire restrictions change frequently. You must verify current permits, quotas, and regulations with the responsible land manager before foraging. The App’s public-lands overlays, if any, are informational only and do not grant permission.
3.4 Private land. Entering or foraging on private property without the landowner’s express permission is trespassing and may be a crime. The App does not authorize entry onto private land.
3.5 You are solely responsible for complying with all applicable federal, state, tribal, and local laws, and for any citations, seizures, or civil claims that result from your conduct.
4.1 You voluntarily assume all risks of outdoor travel and foraging, including but not limited to toxic fungi, steep or unstable ground, wildlife encounters, severe weather, hypothermia, equipment failure, GPS error, and lack of cellular coverage.
4.2 User-Shared Tracks & Self-Verification Obligation: Tracks, waypoints, photos, and videos shared by third-party users are provided for informal reference only. The Operator does not verify their currency, safety, or legal accessibility. You are solely responsible for independently evaluating the terrain, weather, and physical hazards of any shared route. If you follow or reference a shared route and encounter an accident, fall, injury, getting lost, or mushroom poisoning, you assume sole and complete liability. The original creator/sharer and the Operator are fully released from any liability or damages.
4.3 Calculated Forest Patches & 3D Mountain Terrain Graphics: Timeliness, Accuracy, and Absolute Disclaimer of Liability:
(1) Computational & Algorithmic Nature (Not Official Surveys or Cadastral Boundaries): All calculated forest patch data (including polygon boundaries, calculated acreage, tree-species composition groupings, fungal habitat inferences, mean elevations, microclimatic weather data, and fruiting reference-value rankings) and 3D mountain terrain graphics (including 3D topographic meshes, digital elevation models [DEM], slope relief, ridge/gully contours, and 3D rendering views) provided by the App are theoretical approximations generated through algorithm data mining and public satellite imagery. They are not 100% accurate, are not official land surveys or cadastral records, and carry no legal authority regarding property boundaries, timber rights, or engineering safety.
(2) Inherent Latency & Timeliness Limitations:
① Forest Patch Timeliness: Satellite remote-sensing orbits and data pipelines have substantial capture and processing latency. Calculated forest patch data cannot reflect real-time on-the-ground dynamics, including timber logging operations, clear-cutting, wildfire damage, tree disease/die-off, seasonal foliage loss, ecological succession, or temporary forestry closures and public land bans instituted by government authorities. Actual ground conditions may differ drastically from displayed data.
② 3D Terrain Graphic Timeliness: 3D elevation models are derived from historical topographic surveys and cannot capture recent sudden geological hazards, such as rainfall-induced landslides, rockfalls, mudslides, bank collapses, or newly excavated road cuts. Users acknowledge that 3D graphic representations inevitably lag behind real-world geological conditions.
(3) Accuracy Limitations, Canopy Obstruction & Concealed Hazards:
① Tree Canopy Concealment: High-resolution satellite elevation data frequently captures top-of-canopy elevation rather than bare ground. Beneath what appears in the 3D graphics as a smooth, gentle forested slope, there may exist sheer vertical cliffs, fatal drop-offs, deep crevasses, sinkholes, boulder fields, or raging torrents entirely hidden beneath the canopy. The App cannot depict micro-terrain obstacles or impenetrable undergrowth.
② Perspective Distortion: Virtual camera angles, elevation exaggeration, and perspective projections in 3D views can create optical illusions regarding slope steepness and traversability. Users must never rely on 3D mountain graphics to evaluate climbing, scrambling, or emergency egress feasibility.
③ Patch Boundary Tolerances: Polygon boundaries are algorithmic approximations with inherent geometric tolerances. Species classifications are statistical probabilities, not on-site stem inventories. The presence of a calculated forest patch never implies even terrain or navigable trails.
(4) Land Ownership, Private Property Trespassing & Sole Legal Liability:
Public land (prot) or protected-area designations in forest patches are rough macro-level references only and do not constitute permission to enter or harvest. Users have an absolute independent legal duty to confirm property boundaries and obtain lawful permission prior to entering any forest block. If a user enters private property (committing civil or criminal trespass), enters restricted nature reserve zones, or violates forestry permit rules based on App data, the user assumes sole and complete civil, administrative, and criminal liability. The Operator and developers disclaim all joint and several liability.
(5) Physical Safety & Assumption of Injury/Death Risk (Self-Reliance Mandate):
Users must rely strictly on physical visual observation of actual on-site terrain and sound backcountry judgment. If a user suffers an accident, falls from a cliff, gets trapped, suffers hypothermia, sustains bodily injury, or dies as a result of relying on calculated forest patch data or 3D terrain graphics, the user assumes 100% of the risk and consequences. The Operator and developers are fully released from any liability, wrongful death claims, or damages to the maximum extent permitted by law.
(6) Commercial Harvesting & Economic Losses Disclaimed:
Fruiting reference values and habitat scores are educational and research approximations, not guarantees of harvest volume or commercial return. The Operator disclaims all liability for lost wages, travel costs, equipment depreciation, commercial contract breach, or lost business profits incurred from relying on forest patch or terrain data.
4.4 Severe Weather, Mountain Microclimates & Force Majeure: Weather in mountainous terrain is subject to violent local shifts. Users must independently monitor weather conditions and retreat at the first sign of storm, flash flood, or extreme drop in temperature. All losses, damage, or injuries resulting from natural disasters or severe weather are assumed exclusively by the user.
4.5 Independent Offline Meetups, Carpooling & Online Outing Team Tracking Disclaimer (including Anti-Luring & Real-Time Location Sharing):
(1) Not an Organizer & No Identity Vetting: The App is purely a mapping utility and communication tool; it is not a travel agency, tour operator, outdoor club, or event organizer. The Operator does not vet, screen, or authenticate the true identity, background, or character of any user or friend.
(2) Stranger Danger & Anti-Luring in Backcountry: Backcountry terrain is remote and dangerous. Users face the risk of being lured, tricked, or led into isolated locations by strangers or bad actors under the guise of finding mushrooms or backcountry guiding, creating risks of extortion, fraud, robbery, assault, or unlawful detention. Users must independently verify fellow members and must never hike into isolated backcountry areas with unverified strangers. Users assume sole and complete liability for any harm, deception, injury, or criminal victimization resulting from interacting with or teaming up with strangers.
(3) Real-Time GPS Location Sharing & Live Tracking Risks: By joining an outing group or enabling location sharing, you expressly and irrevocably authorize the continuous transmission and display of your precise live GPS coordinates, heading, speed, elevation, and battery status to all members of the outing. Teammates can continuously see and observe your real-time physical position and movement. Sharing live location may expose your travel patterns, home location, or secret foraging spots, and poses risks of being trailed, tracked, stalked, or ambushed. You assume 100% of the risks and legal consequences of sharing your live location.
(4) User Controls, Technical Limitations & Complete Waiver: The App provides features to "Pause Sharing" and "Leave Outing". You must immediately pause sharing or leave the group if you detect any suspicious activity or feel unsafe. Cellular dead zones, battery failure, or satellite multipath may delay or drop teammate positions; the App does not constitute a guide, chaperone, or emergency rescue service. The Operator disclaims any duty of care or liability for vehicular accidents, interpersonal disputes, injuries, dropped-out/lost teammates, stalking, harassment, or fatalities arising from online outings or offline interactions.
4.6 Battery Depletion, Cold-Weather Shut-Off & Navigational Backups: Continuous high-precision GPS track recording, display illumination, and background compass computations consume substantial battery power. In high-altitude or cold-weather backcountry environments, smartphone lithium-ion batteries are prone to rapid voltage drops or sudden thermal shutdown. Users are strictly required to verify full battery levels prior to entering the wilderness and to carry sufficient auxiliary power banks, physical paper maps, and a traditional magnetic compass. The Operator disclaims all liability for getting lost, stranded, or suffering hypothermia due to uncharged, cold-drained, or malfunctioning mobile devices.
4.7 Voice Guidance & Off-Route Advisory Limitations: Voice pace alerts and off-route directional warnings are generated via algorithmic client-side estimations and may experience latency or positional inaccuracies under dense tree canopy or steep ravines. Users must continuously maintain visual observation of physical terrain and never step forward blindly onto steep cliffs, loose scree, or waterways solely relying on voice audio cues.
4.8 Device Limitations & No Emergency Rescue Guarantee: The App is not an emergency dispatch system or beacon. Cellular signal is frequently absent in the backcountry; devices may lose power, freeze, or suffer satellite multipath interference. Users are required to carry physical navigational backups (paper maps, magnetic compass, whistle, survival blanket, satellite messenger). The Operator provides no search-and-rescue services and assumes no liability for rescue operations or expenses.
4.9 Physical Health Self-Assessment & Supervision of Minors: Users must be in adequate physical health for backcountry conditions. Individuals with heart disease, respiratory illness, or other serious health conditions must not participate in rigorous backcountry hiking. Minors must be accompanied and supervised by a parent or legal guardian at all times, with the guardian assuming full legal responsibility.
4.10 To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for personal injury or death, arising from the App or outdoor activity—even if advised of the possibility.
4.11 Some jurisdictions do not allow certain disclaimers. Where a limitation is unenforceable, it is modified to the minimum extent needed to be enforceable, and the remainder stays in effect.
5.1 Do not use the App to violate law, damage ecosystems, start illegal fires, harass others, or interfere with emergency or land-management operations. Strict fire safety: Never bring open flames or smoke in prohibited forest zones; users assume all criminal and civil liabilities for wildland fire ignition.
5.2 Practice Leave No Trace principles. Do not harvest protected species or collect beyond legal personal limits.
5.3 Cloud Uploads & Sharing: You may upload recorded tracks, photos, and videos to our cloud servers for storage and share them with other users. You represent and warrant that you own or have the lawful rights to upload and share such content, and that it does not infringe third-party rights, violate laws, or provide maliciously misleading/dangerous navigation.
5.4 Restricted & Sensitive Facility Mapping Prohibited: Users are strictly prohibited from using the App to record, survey, map, or upload coordinates or imagery of military installations, national security perimeters, classified scientific facilities, or sensitive critical infrastructure. Any violation of national security or geographic secrecy laws is solely the user's responsibility.
5.5 Zero Tolerance for Objectionable Content & Abusive Users: There is no tolerance for objectionable content or abusive users. You must not upload, share, or send content that is harassing, threatening, hateful, sexually explicit, violent, defamatory, fraudulent, or otherwise objectionable, and you must not abuse, stalk, or harass other users. You are strictly prohibited from using the Friends, Outings, or GPS location-sharing features to lure, deceive, stalk, trail, harass, defraud, or endanger any other person. You can report a user from the Friends screen (Report) or by emailing [email protected], and you can remove and block any user at any time. We review every report within 24 hours; content that violates these Terms is removed and the responsible accounts are suspended or permanently banned.
6.1 The App’s software, UI, derived map styling, and models remain our intellectual property (or that of our licensors). Public geographic datasets remain subject to their original licenses.
6.2 Anonymized Ecological Research License: By uploading tracks, photos, and videos to the cloud, you grant the Operator a license to use such data in a de-identified, anonymized format for scientific research on fungal ecology, micro-habitats, and species distribution modeling.
6.3 Privacy & Non-Disclosure Commitment: The Operator pledges never to publish, sell, or disclose raw, unredacted GPS track coordinates, private pins, or original photos/videos without reservation. Any research insights or models will only be deployed or displayed in aggregated, anonymized, and de-identified formats within the App.
6.4 You may not reverse engineer, scrape, resell, or redistribute the App or its non-public derived layers without written permission.
7.1 These Terms and any disputes arising out of or related to the App shall be governed by applicable mandatory laws, without prejudice to any mandatory consumer protection laws of your jurisdiction of residence. If you have any dispute or concern, you and the Operator agree to first attempt to resolve the dispute informally and amicably through good-faith negotiation by contacting us at [email protected].
